Bloomberg View columnist Jonathan Alter said that if the Supreme Court rules the health care individual mandate unconstitutional, it could pull "a thread on the whole blanket of one seventh of the American economy."
"If you're an insurance company and there's no mandate," Alter told The Ed Show host Ed Schultz, "you can't stay in business."
The individual mandate is the portion of the Patient Protection and Affordable Care Act that requires all Americans to seek health care coverage or face a penalty. Alter argued that striking down the mandate would make it impossible for health care companies to survive the other requirements imposed on them by health care reform, such as a ban on charging higher premiums for consumers with pre-existing conditions.
MIT economist Jonathan Gruber has made similarly dire predictions. In a February 2011 paper for the Center for American Progress, he wrote that "no alternative to the individual mandate can cover more than two-thirds as many uninsured as the Affordable Care Act does." Furthermore, "any alternative imposes much higher costs on those buying insurance in the new health insurance exchanges as the healthiest opt out and the less healthy face increased premiums."

As with any contract without provisions of severability, any portion deemed illegal, renders the WHOLE contract unenforceable. As far as I know, The Affordable Care Act did NOT include language to insure severability, leaving remaining ancillary mandates, regulations and authority, in place.

Nope. Obamacare and it's mandate was implemented at the federal level vs. state (Romneycare). This is why the Supreme Court will rule it unconstitutional this month because it's a state right, not a federal right, and the Commerce Clause does not support this instance. States can have a mandate.

Before that could happen GWB was selected, gave the surplus away to the wealthy and went on a borrow and spend spree at the end of 8 years totaled 15 trillion plus interest. Here are some real facts for "flat earth" conservatives. All other major industrialized countries that the U.S. must compete against for jobs have some sort of universal health insurance system. The United Kingdom, Australia, Canada, and New Zealand provide all of their citizens with excellent health care coverage for about 9% to 10% GDP. The U.S. spends 17% GDP for our grossly inefficient health care system. The U.S. ranks about 30th when ranked by all industrialized countries in infant mortality and longevity statistics, the two main statistics used to asses public health care outcomes for societies by scholars. We spend twice as much per capita for our inefficient health care system as any industrialized country. We have 50 million uninsured in America. We have at least another 20 million under-insured. We lose 45,000 uninsured Americans to premature deaths from treatable medical conditions because they lack access to the health care system. Over one million bankruptcies are filed annually for expensive medical bills. Many of these patients had medical insurance but were cut off by the insurance company. Every single time one of the uninsured goes to the Emergency Room it costs the average policy holder an extra $1100 annually. This cost shifting is a major reason for the rise in health insurance premiums. These are facts that are easily looked up on line. If you do not know these facts you should not be coming on a public blog because you are incompetent to talk about the issue of health care in America.
Asian countries and other industrialized countries can out compete us because they have more efficient single payer systems for health care. General Motors pays $1500 extra per car in the U.S. to cover health care costs. GM pays more for health care than they do for steel in the car. The bulk of future budget deficits are caused by double digit increases in premiums. The cost of an annual premium for a family health insurance in 2011 was around $13,000. By 2020, this same premium could be $26,000 annually or higher. Median income in the U.S. was about $54,000 annually in 2007. Assuming only a modest gain in income because middle class incomes are stagnant, most Americans will not be earning more than $60,000 in 2020. This implies that the employers of these Americans below median income will not be able to afford to offer health insurance to their employees by 2020. This means that 150 million Americans are in serious danger of being uninsured or under-insured by 2020. The other insured Americans in the upper median groups will also face increasing fees, co-pays, deductibles, and caps on their insurance.
The world of conservatives is an America where 150 million Americans will be under-insured or uninsured by 2020. The Asian countries and Western European countries will have a growing structural economic advantage in job creation and high tech company start ups. Venture capitalists and others will look at American economic uncompetitiveness and wisely invest their money in Asian or Western European economies or perhaps industrialized Brazil that have healthier workforces. America can not compete against Asian industrial powerhouses without universal health care coverage. This is the conservative vision for America: let millions of Americans go bankrupt and our economy stagnate and ossify because we can not compete against other BRIC nations that have universal medical care for their citizens. In other words countries that have universal health care will have growing economies and will steal all of America's corporate high tech start ups and all of our good paying jobs by default if we do not have universal health care.
America will also lose its military edge as well without universal health care coverage. Billions of taxpayer dollars get wasted annually when recruits washout of expensive training because of preexisting medical conditions. As a retired Army Sergeant I know this angle all too well. Too many young people come into the military without having come from homes with adequate health insurance. Many recruits in the military receive $500,000 plus in training. Those in higher technical job skills receive more than a million dollars worth of training. Many of the failures on the Army physical fitness test were caused by these preexisting conditions not being addressed by a family care provider when the recruits were school aged students. Mark my words, the day a four star Admiral and a four star General from the Joint Chiefs of Staff have to report to Congress that we do not have enough healthy recruits to defend our nation we will have 90 plus Senators voting for a Medicare public option and Medicare for all those too poor to pay Medicare premiums. Conservatives in Britain supported the British National Health System because the British military complained that too many recruits were rejected for military service or failed out of training because of lack of access to medical care. So supporting a Medicare public option is good for British and American national security for military readiness.
If you are a conservative I challenge you to come up with a solution of your own for affordable health care. Don't waste my time with your B.S. talking points from the RNC or Fox News. What are Republicans going to do so solve this health care crisis in America? How will Republicans find affordable health care coverage for 50 million uninsured Americans? Conservatives fail to explain their plan for the 32 million uninsured Americans who will receive health insurance under the Affordable Care Act? Conservatives love to bitch, moan, and complain about health care but when they get elected to office they always take government run health insurance for themselves and their families. The nine Supreme Court judges who will decide the future of the Affordable Care Act all receive government health insurance for themselves and their families. Regardless of how the Supreme Court rules, someday soon a four star Admiral or General will testify that on national security grounds we must have a Medicare for all public option because we do not get enough volunteer recruits who can pass the physical and medical demands of military service. Conservatives opposed to the Affordable Care Act never talk about this issue medical coverage for all and military preparedness of our nation.
Any conservative that does not understand this issue after reading these paragraphs is a moron who does not care about the future of the United States of America or its military preparedness. I trained troops in the U.S. Army for 20 years. I know this health care issue inside and out. Those conservatives who have not been in the military or who have not trained troops for combat are really clueless idiots about a very serious national security and economic competitiveness issue caused by our dysfunctional health care system.
Our health care system is an abomination to any literate human with moral scruples. President Obama is trying to do something to solve this problem with the passage of the Affordable Care Act. If you a conservative who opposes the Affordable Care Act, you are saying that profits for private health insurance companies are more important than the military readiness of our nation. This conservative position is indefensible. "Flat earth" conservatives, are intellectually deficient like sheep. Nothing that the Supreme Court decides will change anything written here by a retired U.S. Army Sergeant with seven years of college and three years of high tech training and combat support service in six conflicts including front line combat service in the Persian Gulf war. It is only a matter of time until we have a Medicare for all public option. I never get a thoughtful response from a conservative about health care. At least President Obama has the moral courage to try and help America with the Affordable Care Act. Conservatives who criticize President Obama and offer no solutions for affordable health care on their own while 45,000 Americans die annually, are gutless cowards who prefer to bitch like little spoiled children on the playground who didn't get their turn on the swing set. Vatican: Canadians do not cross the border for basic medical services in America. A few might get referred to a medical specialist only at their own convenience for non-life threatening surgeries. Canadians are not flocking to Grand Forks, ND or Fargo, ND because the hospitals in Winnipeg are just as good as anything we have here including the Mayo Clinic in Rochester. Besides they get no bills in Canada.
I knew many Canadians who served in their country's military. Most Canadians thought that the American health care system is a huge rip off supported by ignorant American conservatives. The Canadian system is vastly superior to the American medical system because they get universal coverage and family care providers. The Canadians spend about 9% GDP on health care with better longevity and infant mortality statistics in America where we spend 17% GDP for inferior health care that buys Cadillacs and BMW's for health insurance company executives while screwing and killing American patients.
Canadians are also outperforming America in education ranking first in the number of college educated citizens aged 25 to 35 while we in America have slipped from number one to number eleven. I guess Canadians are just a hell of a lot smarter than ignorant stupid American conservatives who are too incompetent to blog here. I have lived in the United Kingdom and served beside many Canadians in the military. I know what I speak of from first hand knowledge while you have your head stuck up your rectum. Go get yourself an enema so you can clean out your conservative brain cells and go to the library and do your research.

One common assertion among the left is that other industrialized nations, such as Canada, achieved great success in health care within their collectivist framework. This, then, begs the question: why is the head of an east coast Canadian province coming to the United States for medical treatment?
Newfoundland Premier Danny Williams is seeking heart surgery in the United States, drawing criticism from “local bloggers and people calling in to the province’s immensely popular open-line radio shows.” Yet his actions are hardly unusual for world leaders. Saudi Arabian King Abdullah bin Abdulaziz is known to have his checkups at the prestigious Mayo Clinic in Rochester, Minn. Italian Prime Minister Silvio Berlusconi had heart surgery at the Cleveland Clinic in 2006 . Even middle-class Canadians are utilizing their proximity to the United States to seek treatment here.
A study by Steven Katz, Diana Verilli, and Morris Barer in Health Affairs examining the Ontario Health Insurance Plan from 1987 to 1995 found “evidence of cross-border care seeking for cardiovascular and orthopedic procedures, mental health services, and cancer treatments,” although not widespread. Examples include the governments of British Columbia and Quebec sending patients to the United States for coronary artery surgery and cancer treatment. Shona Holmes, a Kingston, Ontario resident in need of an endocrinologist and neurologist, crossed the border when she was told to wait “four months for one specialist and six months for the other.” Karen Jepp delivered identical quadruplets in Montana “because of a shortage of neonatal beds in Canada,” with the Calgary health system picking up the tab.
Perhaps Canadians’ health care migration patterns are a result of their own centralized system of government health care planning and “free care” crashing into the government’s budget constraints. The annual study “Paying More: Getting Less“ produced by the Fraser Institute, a Canadian think tank, found that government-run monopolies established in each province of Canada (simultaneously barring private operators from competing for the delivery of public health services) produce rates of growth in government health care spending that are “not financially sustainable through public means alone.” Each province’s policy of insulating consumers from price signals, such as premiums, co-payments and deductibles, has naturally led to over-consumption of medical treatment. Thus provincial governments, encountering fiscal restraints, must resort to long queues and the rationing of care.
And wait patients must. A hospital survey of five countries (United States, Canada, New Zealand, United Kingdom and Australia), conducted by Robert Blendon and colleagues in Health Affairs found that “waits of six months or more for elective surgeries were reported to occur ‘very often’ or ‘often’ by 26–57 percent of executives in the four non-U.S. countries; only 1 percent of U.S. hospitals reported this. Half of all Canadian hospitals reported an average waiting time of over six months for a 65-year-old male requiring a routine hip replacement; no American hospital administrators reported waits this long.
Perhaps if Canadian provinces adopted a free-market approach to health care, more of their citizens (and politicians) would seek treatment within their borders. This leaves just one question: if the United States adopts government-run health care system, even remotely like that of Canada, with government control of benefits and financing, plus reams of rules specifying what we can and cannot get, which border are we going to cross to get the care we need?

Most Canadians were very surprised when the OECD PISA studies ranked us among the best performing education systems in the world - and many Canadian probably still do not believe these results. Yet for four rounds now, Canada has been among the top performing countries, and also one with smaller than average gaps between high and low performing students.
Canada has many similarities to the U.S. in education. We have virtually no federal government presence in schooling; the 10 provinces and three territories run the systems. We also have a system of local districts with elected boards, as in the U.S., that developed as the country was settled by European arrivals. Many Canadian schools, especially in our cities, are very diverse; in Toronto, where I live, about 50% of the population was born outside of Canada, from all parts of the world. In western Canada, more than 10% of students are Aboriginal. Yet, Canada has consistently been a high performing country on international assessments of student performance. Compared to the U.S., the main difference is that Canada has a much smaller proportion of low performing students; performance at the top end of the distribution is quite similar.

Since Rep. Paul Ryan’s (R-WI) new budget eliminates $1.5 trillion from the Affordable Care Act, cuts $770 billion from Medicaid and reduces Medicare spending by $200 billion, Ezra Klein points out that “it would be very interesting to see an estimate of the uninsured population under Ryan’s budget.” The Congressional Budget Office (CBO) analysis of Ryan’s plan does not provide those numbers, but a rough back-of-the-envelope estimate suggests that at least 48 million Americans could lose their health insurance:

– 33 MILION FROM HEALTH REFORM: The budget repeals the Affordable Care Act’s requirement to purchase health insurance coverage, the provision of subsidies for lower-income Americans, and the expansion of the Medicaid program. In other words, it completely defunds the law’s investment in reducing the number of uninsured. As a recent CBO estimate found, compared with prior law, “the ACA is now estimated by CBO and JCT to reduce the number of nonelderly people without health insurance coverage by 30 million to 33 million in 2016 and subsequent years.”
– 15 MILLION FROM MEDICAID CUTS: The budget would eliminate the existing matching-grant financing structure of Medicaid and would instead give each state a pre-determined block grant that does not keep up with actual health care spending. This would shift some of the burden of Medicaid’s growing costs to the states, forcing them to — in the words of the CBO — make cutbacks that “involve reduced eligibility for Medicaid and CHIP, coverage of fewer services, lower payments to providers, or increased cost sharing by beneficiaries—all of which would reduce access to care.” The block grants would reduce federal Medicaid spending by $810 billion over 10 years, decreasing federal Medicaid spending by more than 35 percent over the decade. As a result, economists estimate that states could reduce enrollment by more than 14 million people, or almost 20 percent—even if they are were able to slow the growth in health care costs substantially.
– 1 MILLION FROM MEDICARE AGE INCREASE: The House budget would raise Medicare’s age of eligibility from 65 to 67 by 2034. CBO estimates that while such proposals would reduce Medicare spending by about $150 billion over 10 years, the change would affect roughly 5.4 million seniors. Of this group, about 2.7 million seniors would pick up health insurance offered by employers. Some of the remaining seniors would obtain coverage through Medicaid, qualify for Medicare because they are disabled, or purchase private health insurance in the direct purchase market. But since the House budget would also cut Medicaid and repeal reforms in the Affordable Care Act that would make the direct-purchase market accessible and affordable, many more seniors would become uninsured.

What's the real deal? Reform legislation includes a provision, supported by the AARP, to offer senior citizens access to a professional medical counselor who will provide them with information on preparing a living will and other issues facing older
Americans.
The Second Lie: Democrats are going to outlaw private insurance and force you into a government plan.
The truth: Withreform, choices will increase, not decrease. Obama's reform plans will create a health insurance exchange, a one-stop shopping marketplace for affordable, high-quality insurance options. Included in the exchange is the public health insurance option—a nationwide plan with a broad network of providers—that will operate alongside private insurance
companies, injecting competition into the market to drive quality up and costs down.
If you're happy with your coverage and doctors, you can keep them. But the new public plan will expand choices to millions of businesses or individuals who choose to opt into it, including many who simply can't afford health care now.
The Third Lie: President Obama wants to implement Soviet-style rationing. The truth: Health care reform will expand access to high-quality health insurance, and give individuals, families, and businesses more choices for coverage. Right now, big corporations decide whether to give you coverage, what doctors you get to see, and whether a particular procedure or medicine
is covered—that is rationed care. And a big part of reform is to stop that.
Health care reform will do away with some of the most nefarious aspects of this rationing: discrimination for pre-existing conditions, insurers that cancel coverage when you get sick, gender discrimination, and lifetime and yearly limits on coverage. And outside of that, as noted above, reform will increase insurance options, not force anyone into a rationed situation.
The Fourth Lie: Obama is secretly plotting to cut senior citizens' Medicare benefits.
The truth: Health care reform plans will not reduce Medicare benefits. Reform includes savings from Medicare that are unrelated to patient care—in fact, the savings comes from cutting billions of dollars in overpayments to insurance companies and eliminating waste, fraud, and abuse.

1st of all the government has no intention of paying for every single medical problem that a person may have. That's why Obama hired Dr. Ezekiel Emmanuel, Rahm's brother. His job is to bring "efficiency" into the government run health care system if and when it gets going. Efficiency means cutting costs, that means the 90 yo guy doesn't get a hip replacement.

As noted likely none of us really know what is the ACA. If you are going to cover pre existing conditions (which in general is a good idea) the economics do not work without the mandate. The mandate is the constitutional problem and pulls the commerce clause to a breaking point, where there would be no limits on the power of the central government. Clearly the Constitution was not designed to have a central government without limits.
All that said, the health care system does not work. Work being defined as costs continue to go up ultimately to unsustainable levels. From my own perspective our health insurance premiums went up 15% this year and our insurance consultants advise at a minimum a similar increase next year. It is a sad commentary when a business has to hire insurance consultants just to try and understand and manage the ACA. We try and keep the cost to our employees low, $85 dollars a month for a family plan and we fund a savings account for each employee to cover their deductible. Conversely the principals of the firm (including me) now pay $1200 a month with a $10,000 deductible.
The insurance consultants advise that we may be subject to penalty because we highly subsidize a Cadillac plan for the employees. They further advise that we may be better off to not provide coverage and pay the penalty. We would in that model likely increase the employee salary to off set at least in part the cost of getting a policy through the exchanges or whatever. This is not a good result.
The problem in part at least in my view is that the consitutent groups in health care have little incentive to control and reduce costs. The health care providers likely want higher reimbursement rates. The health insurance companies will just pass on any higher costs. And again in our case, you have no choice but to pay what premiums the insurance company wants there is effectively no price competition. The consumer in sense does not care (if they have insurance) as the insurance company pays the bill.
So what is the solution, as painful as it is for me to suggest, we may need a single payer system. Not suggesting that the federal government is the single payer. The federal government in my view is not an effective adminstrator of dollars as its structure imposes no controls or incentives to control administrative costs.
You could create a giant exchange with all the existing insurance companies. The actual coverage limits etc would likely have to be established by the government. Even a single payer does not deal with the economic problem of covering pre existing conditions such that you could just buy insurance after you are sick. Accordingly it would be good to have an incentive to encourage all to purchase insurance. Not sure what the incentive would be. Congress could have in the ACA just imposed a tax and called it a tax. So maybe that is the solution. And if they had done it as a tax, then likely no constitutional issue.

Rex,what makes you think Obamacare won't be expensive? The truly poor who are not paying anything will still not be paying anything. How many people in this country can afford health coverage but chose not to? How many people are delusional and think some how this is going to be free?
Here is a New York Times article by Tamar Lewin, "Once a leader U.S. lags in college degrees", from July 23, 2010, that describes the U.S. ranking 12th out of 36 industrialized nations. The top of the list had Canada for the number of people with at least an Associates degree at 56% in the age group from 25 to 34. The U.S. is slipping in public education outcomes with only 40% of Americans aged 25 to 34 with at least an Associates Degree. We can thank the Bush era policies for under investments in public and higher education. Bush wasted money on two wars in Iraq and Afghanistan while giving tax cuts to the wealthiest Americans for this result. We should have kept the peace and the tax rates at Clinton era levels and invested more money in education. Bush's policies have set America back for at least a generation. China and India are producing more scientists, mathematicians, and technicians than America is. The future economic growth will be in Asia not in America unless substantial U.S. resources and effort is placed on higher education and making college more affordable for our young people hamstrung by huge debt loads of $30,000 on average.
Rex, if they don't already know, it's because they don't want to. They don't want any information that might possibly benifit this country or it's people if it happened to come from President Obama. That is just fact, as has been proven by the right wing comments on this blog site.

Larry, you are of course correct. The right wingers have become really a pathetic bunch of liars and losers. Facts mean little to people who support huge tax cuts for the rich during a time of two wars! Then these right wingers wonder why the country is such a screwed up mess? Well guess what stupid conservatives? Wars can not be turned off like a water faucet. They have a nasty habit of lasting for years longer than anyone wants to admit because history teach us that wars have a life all their own. Nobody wants to lose one wants they start so they fight on regardless of loss until catastrophe strikes. Some of the neocons on the right are calling for a military intervention in Syria. Syria has a huge army with lots of tanks, modern Russian surface to air missile systems, and ballistic missiles with chemical warheads aimed at Israel. Sure Bashar is a rotten tyrant but we can not go around and "fix" every problem or stop every massacre in the world. We could be occupying Syria for the next ten years if we got involved. If Syria launched its ballistic missiles with nerve gas on Israel all hell would break lose in the Middle East leading to complete disaster and regional war possibly with Iran. Such a scenario could cost us 100,000 casualties, lead to $200 per barrel oil, and add trillions more to our national debt. But this is what many conservatives believe we should do including Mitt Romney. Sorry if we have to fix our problems here at home like health care. There are too many Americans already dying and going bankrupt right here on the home front.
