The Obama administration will stop deporting, and begin giving work permits to younger illegal immigrants who came to the U.S. as children and have since led law-abiding lives. The election-year initiative addresses a top priority of a growing Latino electorate that has opposed administration deportation policies.
The administration's decision could affect as many as 800,000 immigrants.
In a statement this morning, Homeland Security Secretary Janet Napolitano, said “Our nation’s immigration laws... are not designed to be blindly enforced without consideration given to the individual circumstances of each case. Nor are they designed to remove productive young people to countries where they may not have lived or even speak the language."
Illegal immigrants will avoid deportation and be eligible for work permits if they arrived in the U.S. before age 16, are younger than 30, have been in the country for at least five continuous years, have no criminal history, graduated from a U.S. high school or earned a GED, or served in the military.
The president will deliver remarks about the new policy in the Rose Garden at 1 p.m. this afternoon.
The policy change bypasses Congress and partially achieves the goals of the so-called DREAM Act, a long-sought but never enacted plan to establish a path toward citizenship for young people who came to the United States illegally but who have attended college or served in the military. Republicans blocked the DREAM Act in 2010.
Rep. Steve King, an Iowa Republican and vice chairman of the House Immigration subcommittee, told Fox Latino Thursday that he would not support any of the versions of the Dream Act currently being batted around, including one by Rep. David Rivera and Sen. Marco Rubio, both Florida Republicans.
An NBC News/Wall Street Journal poll last month found President Obama leading Mitt Romney among Hispanic voters 61 percent to 27 percent. But the Obama administration's deportation policies have come under fire. In 2011, Immigration and Customs Enforcement deported a record 396,906 people.
Both candidates are expected to head to Florida next week to address the National Association of Latino Elected Officials at a conference in Orlando. The Obama administration's new policy has the same goals as the limited version of the DREAM Act proposed by Sen. Rubio, which stops short of offering young illegal immigrants citizenship, but gives them a type of legal status. Romney said he was considering the proposal from Rubio.
This week, TIME Magazine featured young illegal immigrants in its cover story. Former Washington Post reporter Jose Antonio Vargas, who was brought to the U.S. illegally by his aunt when he was 12, was featured with other immigrants who have publicly shared their story about their lack of legal residency status.
According to Napolitano, United States Citizenship and Immigration Services and Immigrations Custom Enforcement are expected to begin implementation of the application processes within 60 days. Individuals who are already in deportation proceedings but have already been identified as being eligible will be offered deferred action for a period of two years.
Update 11:20 a.m. ET: On a DHS press conference call, reporters quizzed DHS officials on whether the new policy would actually encourage illegal immigrants to step out of the shadows. Coming forward could be seen by some illegal immigrants as a risk, particularly under a different president who might have a change in approach in dealing with the problem of illegal immigration.
"We are encouraging people to take advantage of deferred action... and apply separately for work authorizations, but people can make their own decisions whether their circumstances warrant the application," a DHS spokesperson said, adding that the ability to legally apply for a job and obtain a driver's license will likely be incentives.
While deferred action will give temporary relief to individuals—and while those eligible will have paperwork for two years at a time, subject to renewal—Congress still has to act on a permanent solution, DHS officials said.
Undocumented immigrants under the age of 16 will not be eligible for the waiver but will not be subject to deportation.
Officials also said the policy will enable them to focus resources on illegal immigrants who are public safety and national security risks.

Consider it this way: A person robs a bank and kills a teller. Let's see how in favor of illegal's rights you are when it's your identity that's been stolen and sold to some hard working Mexican who uses it to buy a house and car and run up several credit cards so they can send all the money they earned back to their families in Mexico. They then move on to another identity leaving the collectors to hound you day and night while you try in vain to explain to them that you never lived in Arizona let alone purchased a pick-up truck down there.
They say this will be granted to those with no criminal history... but their entire existance in this country is criminal. They lie on government forms every day. Well this is clear pandering and doesn't surprise, but both sides do it so nobody can say anything either way to that effect.
That aside, I think this is great (be nice if it was done at another time to avoid the pandering tag but at least it is happening) and I do think other parts of the government should be involved but still. As long as they meet those requirements, and I'm guessing most speak English, if not then that needs to be another requirement, get them the visa's then get them on their way to be American citizens. In the process we can take 800,000 of the lazy welfare leeches that don't meet those requirements but where just lucky to be born here and ship them back to Mexico.
This is something that is long time coming but shouldn't just stand alone, there are other actions/reforms needed regarding immigration, especially if this is going to happen.
-First off the 14th amendment needs to be amended and made clear so that this issue of "anchor" babies is solved and cannot happen anymore. One parent must be legal citizen, not just born here. Simple.
-Then I think there should be another group, meeting similar requirements as these kids do, that can apply for a work visa or citizenship, pay a small fine/fee and be allowed to become citizens, though the number needs to be controlled and limited- I'm saying a couple million or so, not 10 of the 13-15 million illegals. Like as been tossed around.
- Following that we need a revised work Visa program, starting off it can have only so many applications - another 3-4 million,then adjust from there. Part of their pay goes back to government like everyone else (though a revised tax code would greatly help all of this but that is for another article).
-Then finally we start actually enforcing the laws, by deporting the illegals, then fining and jailing business owners that offend. Also putting troops on the border for the time being. If repeats become a major problem setup detention camps and hold them for 6months to a year. Camps would be strictly monitored for human rights reasons but intent would be as a deterant. Can't work, then families don't get money. And I'm talking not the whole family stays if they come, just the father, rest go back. Not trying to be heartless or cold just deter people from making the illegal entry. Doesn't work then try something else.
There are other things we could probably do as well but I think this would a good start and it is time to put these into action. The main thing is I think it tries to at least meet in the middle and help pave the way for other positive actions but owns up to that fact people are here illegally and that some groups, as hard as it is, need to admit that and try to work together towards something that is reasonable but doesn't cause major negatives for those here legally either.

It is hateful to criminalize children for the acts of their parents.
I know several kids here in S.TX who came here as tiny children, have grown up in American communities, gone to school here and are completely as American as any of you "I'm natural born so therefore I'm better" idiots. These kids did not even know that they were "illegal".
They worked from the time they were old enough, sometimes at two or three jobs that believe me, their Anglo counterparts would have deemed demeaning. These kids graduate from high school with honors and then when they are ready to go out into the "real" world, they find that they are criminals. It is a terrifying experience to say the least.
In the small communities here I have seen neighbors (of all races and ethnic backgrounds and citizenship) come together to protect these children and make sure that they get to college and stay off the ICE radar.
The president is doing what should have been done a long time ago. Did you know that we had/have thousands of children incarcerated in detention centers in this country because they were caught being here illegally? Children, some as young as eight years old in jail just for existing someplace that man's law says they shouldn't. Once caught the idea is to deport them back to their country of origin, (if they even know where they came from) a place they do not know, nor do they have any family or resources once repatriated. That is cruel and unusual punishment no matter how you slice it.
Personally, I am not very happy with Obama for a lot of reasons, this is not one of them. This decision shows compassion and an understanding that children are our future, no matter where they came from. My children fall into the age range mentioned here. My son just graduated from college over a month ago, and he hasn't been able to find a job yet. This could potentially affect his job search, as he could be competing with illegals who have obtained a work permit, as well as a college degree. See how this affects us yet?
In this case, it doesn't mean anything. You can't prosecute these people because they didn't do anything wrong.
Remember; You have to actually be guilty of doing something. When a child is brought over and lives here with his parents, he's not breaking the law. Therefore, he's not really illegal, but in an odd sort of legal limbo.

The truth is that the vast majority of immigrants did NOT come through Ellis Island. They just came here and entered the country w/out inspection and did not enter via NY City.
And even those who enter via NYC did not all go through Ellis Island. Those immigrants who came on ships with 1st or 2nd class tickets were allowed to get off in Manhatten; it was only the poor folks who crossed the ocean in the lower class section (steerage) who were kept on board and permitted to get off the boat through Ellis Island.
Most other Northern European immigrants (of which were all of my relatives) entered any number of port of entries from Canada to New Orleans and most with a cursory, at best, "inspection". The classification of "Legal and Illegal" immigration did not begin until the 1920s. The Chinese Exclusion Act and other restrictions on non-Anglo immigration, however, were enacted long before.
One final point... Texas became a part of the United States because of "illegal immigration". Mexico promoted the settlement of US immigrants in its northern territories on the condition that they would profess loyalty to the country. Large numbers of US immigrants began to settle and then declared their opposition to Mexico and their desire to establish the Republic of Texas. Ergo, the Alamo and the Mexican American War which was denounced by Abraham Lincoln, Mark Twain, and countless others. We know the result.
What is never discussed currently is how the companies that left the Midwest and established themselves along the southern border in Mexico attracted large numbers of Mexican citizens to the region for employment. These same multinationals which then closed these plants and moved to SE Asia contributed significantly to the question of illegal immigration. After pulling large populations to the border region, empty plants forces many to look for employment in US since none was now available in Mexico. It is most unfortunate that so many choose to ignore this fact and instead blame those who seek jobs so as to survive.
It seems that for many "illegal immigration" is good or bad, depending on your self-interest. What is lacking, sadly, is wise, thoughtful, and measured discussion about the entire topic of immigration. In the meantime, let's not play our political games and make children pay for our unwillingness to find a way to honor our tradition as a nation of immigrants and at the same time make wise decisions for the future.
BTW All of my relatives were legal (there were no illegal immigrants from northern Europe when they came) and none of them came through Ellis Island.

Well, it just so happens I live in Florida. My wife, who has a green card and is not a citizen, received a voter registration form in the mail last week - which she easily could have filled out and sent back and I'm sure no one would have noticed, or cared what her immigration status was.
We even got a recorded message yesterday from our local Supervisor of Elections asking why she hadn't sent it back!
